Terms and Conditions of Carriage

These Terms and Conditions (“Conditions”) govern all services provided by Destiny Couriers Sameday Limited (“Destiny Couriers Sameday”, “we”, “us”, “our”) to any customer (“Customer”, “you”).

By placing a booking with us, you confirm that you have read, understood, and agree to be bound by these Conditions.

⚠️ Important: Your attention is particularly drawn to Section 11 (Limitation of Liability).


1. Definitions

  • Account: A registered customer account containing contact and billing information.

  • Booking: A request for delivery services made via phone, email, or our website.

  • Business Day: Monday–Friday excluding UK public holidays.

  • Consignment: Goods or items submitted for delivery.

  • Consignee: The recipient of the Consignment.

  • Services: Courier and logistics services provided by us.

  • Excluded Goods: High-risk or restricted items (see Section 4).

  • Prohibited Items: Illegal or banned goods.


2. General

2.1 We provide courier and logistics services including same day, overnight, and international deliveries.

2.2 We are not a common carrier and reserve the right to refuse any Booking.

2.3 These Conditions apply to all Services unless otherwise agreed in writing.

2.4 Where applicable, international road transport may be governed by the CMR Convention.

2.5 These Conditions apply primarily to business customers. Consumer rights are not affected where applicable by law.


3. Bookings

3.1 All Bookings must be submitted via phone, email, or our website.

3.2 A contract is formed only when we confirm acceptance of your Booking.

3.3 Quotes are valid for 14 days unless stated otherwise.

3.4 We may refuse or amend any Booking at our discretion.

3.5 Additional charges may apply (e.g. waiting time, address changes, special handling).


4. Goods Restrictions

4.1 Prohibited Items

You must not send illegal, dangerous, or restricted goods.

4.2 Excluded Goods

These include (but are not limited to):

  • Jewellery, watches, precious metals

  • Fragile items (glass, china, artwork)

  • Perishable goods

  • Cash, vouchers, financial instruments

  • Tobacco, alcohol

  • Firearms, explosives

Such goods are carried only by prior agreement and may incur additional charges.

4.3 Dangerous Goods

Dangerous goods must be declared in advance and comply with all legal packaging and transport requirements.

We reserve the right to inspect, reject, or dispose of any Consignment that breaches these Conditions.


5. Packaging and Customer Responsibilities

5.1 You are responsible for ensuring all items are properly packaged, labelled, and suitable for transport.

5.2 Inadequate packaging may invalidate any liability or compensation.

5.3 You must provide accurate information including weight, dimensions, and contents.


6. Delivery

6.1 Delivery times are estimates only and are not guaranteed.

6.2 We may choose the delivery route at our discretion.

6.3 Deliveries are made to the address provided at the time of Booking.

6.4 Leave Safe Deliveries

If you request a “leave safe” delivery:

  • The location must be secure and out of public view

  • Items must not be perishable

  • Proof of delivery may include photographs

⚠️ Risk transfers to you upon delivery. We accept no liability for loss or damage thereafter.


7. Failed Deliveries & Unclaimed Goods

7.1 If delivery cannot be completed, we will attempt to contact you.

7.2 If goods remain unclaimed after 7 days, we may:

  • Return them at your cost

  • Dispose of or sell them to recover costs


8. Cancellation

8.1 Either party may cancel a Booking at any time.

8.2 You will be charged for work completed up to cancellation.


9. Charges and Payment

9.1 Payment terms are 14 days from invoice unless agreed otherwise.

9.2 Late payments may incur interest at 4% above Bank of England base rate.

9.3 We may apply:

  • Fuel surcharges

  • Card processing fees

9.4 Charges may be updated with 30 days’ notice.

9.5 All prices exclude VAT.

9.6 We reserve the right to suspend services for non-payment.


10. Data Protection

10.1 Both parties act as independent data controllers.

10.2 You must ensure you have consent to share personal data with us.

10.3 We process data in accordance with UK data protection laws.

10.4 We do not access the contents of consignments.


11. Limitation of Liability

11.1 Nothing excludes liability where it is unlawful to do so.

11.2 To the fullest extent permitted by law, we are not liable for:

  • Loss of profits, revenue, or business

  • Delays in delivery

  • Indirect or consequential losses

11.3 Our liability is limited as follows:

  • Same Day Services: Up to £250 unless enhanced cover is purchased

  • Declared Value Shipments: Up to declared value (subject to fees)

  • Other Losses: Limited to the service charge paid

11.4 Claims must be:

  • Reported within 7 days

  • Submitted in writing within 14 days

11.5 Compensation is based on the lower of repair cost or item value.


12. Insurance & Indemnity

12.1 Any enhanced liability cover is not insurance.

12.2 You are responsible for arranging separate insurance if required.


13. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including:

  • Weather

  • Traffic disruptions

  • Strikes

  • Government actions


14. Customer Obligations

You confirm that:

  • You have authority to send the goods

  • Goods comply with all laws and regulations

  • Information provided is accurate

You agree to indemnify us against losses caused by your breach of these Conditions.


15. Right of Lien

We reserve the right to retain possession of goods until all outstanding charges are paid.


16. Website Use

16.1 Use of our website is at your own risk.

16.2 We do not guarantee it will be error-free or virus-free.


17. Subcontracting

We may subcontract services but remain responsible for performance.


18. Confidentiality

You must not disclose our confidential business information.


19. Legal

19.1 These Conditions are governed by English law.

19.2 Disputes are subject to the exclusive jurisdiction of English courts.

19.3 If any provision is invalid, the remainder remains enforceable.
